Is the law firm you are considering promising a flat fee or other bargain rate to handle your commercial landlord tenant matter?

If so, we caution you to beware and ask questions. When considering an attorney for an important legal matter such as litigation, ask yourself the following question: "is my case being handled by an attorney who I trust will provide me professional and competent service?"

Hiring an attorney for commercial landlord tenant litigation is not the same as buying a product. You are placing your trust in a professional to represent your interest to regain possession of your property and to recover damages or, if you are a tenant, to prevent losing possession of your property and avoiding a loss of your business. This is not the time to hire someone solely because they quote you the best price.

Ask questions about the so called flat fee. Any attorney who offers a flat fee to handle an eviction will tell you that if the tenant contests the eviction, then the attorney will charge you a different fee (typically hourly) for the representation. Uncontested commercial evictions are very rare so you should anticipate in advance that the matter will not be handled on a flat fee basis. And, if that is the case, then consider who is going to be handling the matter on your behalf once it is contested. In other words, if your matter is heading to court, do you have confidence in the attorney who will be representing you?

Consider whether you would hire a surgeon based on who quoted you the best price without considering who you trust with the important procedure. Even worse, consider hiring a surgeon based on a flat fee with the assumption being that here will be no complications but a different fee if there are complications. Would you hire a surgeon who you don't trust to deal with a complicated surgery merely because she is less expensive hoping that there will be no complications?

After you considered everything, do you feel your matter is being handled by the right attorney?

The only way to know this is to speak with the attorney who is actually going to represent you. Alex Rosenthal is available to speak with you at no cost to discuss your matter and help you decide whether Rosenthal Law Group is the right attorneys to handle your commercial landlord tenant matter.
